Terms & Conditions of Sale
These Terms and Conditions govern the use of the website www.sushico.pt and the purchase of products and services offered through it. By placing an order, the Customer declares having read, understood and fully accepted these conditions.
1. Provider identification
The website www.sushico.pt is jointly operated by the following entities, depending on the shop chosen by the Customer when ordering:

When the Customer selects the Braga shop, the sale contract is concluded with POMPA E SUCESSO, LDA.; when the Porto shop is selected, it is concluded with VANILLAFRIENDS, LDA. (in either case, hereinafter "Sushi & Co." or "the Seller").
2. Purpose
Through the website, the Seller offers the Customer the possibility to:
- Browse the menu, allergens and prices;
- Order meals and products for home delivery within the areas we serve;
- Order meals and products for pickup (takeaway) at the shop.
3. Capacity to contract
Ordering products through the website is only permitted to persons with legal capacity to contract (as a rule, over 18 years of age). By placing an order, the Customer declares having that capacity.
4. Ordering process
- The Customer selects the desired products and the shop (Braga or Porto);
- Chooses the mode (delivery or pickup), address and contact details;
- Confirms the order summary and proceeds to payment;
- The Seller sends an email confirmation with the order details and the delivery/pickup estimate;
- The contract is concluded when the Seller confirms acceptance of the order.
The Seller reserves the right not to accept orders with an obvious price error, out-of-stock items, suspected fraud, or that exceed operational capacity at the requested time. In such cases, any payment already made will be fully refunded.
5. Prices
Prices shown on the website are in euros (€) and include VAT at the legal rate in force. Any delivery costs are shown separately before the order is confirmed. The Seller may change prices at any time; the prices in force at the moment the order was confirmed apply to that order.
6. Payment
Payments are processed by the payment service provider IFTHENPAY, Lda. (a Payment Institution authorised and supervised by Banco de Portugal, registration no. 8707), securely and in a certified environment. Accepted payment methods:
- Multibanco reference
- MB WAY
- Credit or debit card
- Cash on delivery or at the shop
- Multibanco card terminal on delivery or pickup
- (Other methods may be enabled in due course; see checkout)
The Seller does not store payment card data. The order is only confirmed after the payment is validated.
7. Delivery
7.1. Area and times
Home delivery is available in the areas listed on the website, subject to each shop's operating radius. The usual delivery time is 30 to 60 minutes after confirmation, and may vary with order volume, traffic and weather conditions. In exceptional situations it may extend up to 7 days (catering or event orders), as previously agreed.
7.2. Receipt
Delivery is considered complete when the Customer (or a person authorised by them at the given address) receives the products. If no one is available to receive the order at the agreed address and time, the Seller may consider the delivery attempted and charge the delivery fee.
7.3. Pickup (takeaway)
Pickup orders must be collected at the chosen shop within opening hours and up to 30 minutes after the indicated time. After that, the Seller cannot guarantee the products' optimal condition.
8. Right of withdrawal
Under the article 17(1)(d) and (e) of Decree-Law no. 24/2014 of 14 February, the right of withdrawal does not apply to contracts for the supply of:
- goods liable to deteriorate or with a short shelf life;
- goods made to the consumer's specifications.
As these are perishable food products prepared to order, confirmed and paid orders cannot be cancelled by the Customer once preparation has started. Before preparation starts, the Customer may request cancellation by contacting the shop: if the request arrives in time, a full refund will be issued.
9. Complaints and quality
Sushi & Co. is committed to delivering products in optimal conditions of quality, temperature and hygiene. If the Customer finds any issue (wrong or missing product, evident damage, quality problem), it should be reported by:

- Deadline: up to 24 hours after delivery/pickup
Upon validation, the Seller will proceed as applicable with: product replacement, credit issue or partial/full refund.
10. Allergens and food information
Products may contain, or be prepared in environments that use, allergens (fish, shellfish, soy, sesame, gluten, nuts, egg, milk, among others). Allergen references on the website are for information only: in case of allergy or intolerance, the Customer should contact the shop before ordering to confirm. The Seller is not responsible for reactions arising from allergen information the Customer chose to ignore.
11. Intellectual property
All website content (texts, photographs, logos, the "Sushi & Co." brand, layouts) is the property of the Seller or used under licence, and is protected by intellectual property law. Its reproduction, distribution or commercial use without written authorisation is prohibited.
12. Limitation of liability
The Seller is liable under the law for the conformity of the delivered products. The Seller's liability does not cover:
- delays or inability to deliver due to force majeure;
- address/contact errors provided by the Customer;
- consequences of food information the Customer chose to ignore (clause 10).
13. Alternative dispute resolution
In the event of a dispute, the consumer Customer may turn to the following entities for Alternative Resolution of Consumer Disputes (under Law no. 144/2015 of 8 September):

14. Personal data protection
The processing of personal data in connection with the use of the website and the handling of orders is carried out under our Privacy Policy, which forms an integral part of these Terms and Conditions.
15. Governing law and jurisdiction
These Terms and Conditions are governed by Portuguese law. Any dispute falls under the jurisdiction of the courts of the district where the selling entity is based (Braga or Porto, depending on the shop), with express waiver of any other, without prejudice to mandatory recourse to ADR mechanisms where the law requires it.
16. Changes
The Seller may update these Terms and Conditions at any time. The version in force is the one published on the website. Periodic review is recommended.
